They still have the right to unionize for collective bargaining purposes and what not. I'm just saying that having a union is probably less important in pro sports than it is for other jobs when the income being made is a lot less.
Guys don't go play in other leagues during the NHL off-season because 1) it's the off-season for pretty much every other hockey league out there and 2) they're not going to play hockey year round, like they would be if they were playing in the NHL and then some other league in the summer.
In theory, yes they could all decide to work out on their own and stay in shape, even do things like scrimmages, but that's also hard to do with players living around the United States and Canada. That said, there's nothing like actually playing in games to stay in shape for those games. Why do you think there are things like training camp, pre-season games, and conditioning assignments to the minor leagues. It's to make sure they're all in game shape. That's something you're not going to get by going to the gym every day and skating a couple of times a week.
IF a season gets under way, it's going to be something like a week to 10 days top training camp. Those players that have been playing are going to have an advantage. I understand the worry about players getting hurt, and I hope Martinez makes a quick recovery. But they can still get hurt working out off the ice or skating on their own or with a few other NHLers, without playing overseas. I remember an off-season where Lappy needed hernia surgery coming into camp because he got hurt working out in the summer. If players are scrimmaging with each other, they can take a puck in the face just like Martinez did in a game. Guys in Canada or back east could slip on some ice and fall and get hurt that way. The only way they'd be 100% is if they move into a plastic bubble.
