So are these guys a quality operation? I have had a difficult time finding a decent jersey vendor who doesn't have issues. Either it is Chinese knockoff crap (ebay, DHGate) or they cut corners (heat pressed numbers). The website says all the right stuff but I want to make sure I'm not buying a story and a headache.
Also, are there any duties associated with buying a jersey from Canada?

I just threw up in my old copyright law text. Not a chance in Hades that these shirts could be fair use or "transformative" (transformativeness being but one element of a fair use analysis), and "derivative" and "transformative" are two completely different concepts (many derivative works are transformative and many are not). The concept of "public domain" has nothing to do with a photograph taken two months ago (unless the photographers have affirmatively abandoned their copyrights, which I doubt). And every work of authorship has copyright protection from the moment it is fixed in a tangible medium of expression -- whether the author "considers it copyrighted" or not. The shirts depicted are unquestionably violations of copyright (and also of Brown's and the team's rights of publicity under California Civil Code Section 3344 and the Downing v. Abercrombie & Fitch case). Doesn't mean they're not tremendously cool. Whether the owners of the copyrights or the players would or would not enforce their copyrights is a completely different issue.
As for posts at this site, yes, they have copyright protection also. However, those copyrights are likely owned by the owner of this site pursuant to the site's terms of service (which I haven't read recently, which is why I say "likely"). Quoting for purposes of comment and criticism is fair use.
