actually the nfl case did manage to make it through the court system. the nfl won, and the decert was classified as a bargaining ploy, not a true decert. that's why fehr isn't eager to use it. the earlier he uses it, the more likely it is to fail. if 2 whole seasons are lost, his case for decert is bolstered hugely. Hard to argue that the process is working when seasons have been lost twice.
So I don't think it happens until after the season is lost.

...meanwhile we still have no NHL Hockey. I hope both parties realize soon that we fans can go without NHL Hockey a lot longer than they can.
