Not totally the same, but in the art departments I have worked in any work that we want to show on camera, be it a commissioned work or not, if it is recognizable as a piece of art you need to get a release from the original artist. I would imagine that they either couldn't or didn't want to deal with getting a release from EYECANDYAIR. This is even starting to be an issue with tattoos, which is a real pain in the ass.

I highly doubt the player has any ownership of the artwork. The artwork on my mask is signed by the artist and even though it is my mask, it is his artwork that I paid for. Technically I doubt I could create copies of the artwork for resale. But that does present an interesting question. The player cards depict a photograph of the player with all their gear on and these cards are sold by the NHL/PA. I know all gear manufacturers pay a licensing fee to have their logos displayed, I wonder how that works for goalie's masks. If I buy a picture of Quick, does the artist that painted Quick's mask see any of the money? If they don't, shouldn't they be entitled to a percentage?
