Exactly. The NHL can hold this deal hostage by failing to select an arbitrator. If the NHL stalls until the end of Sept, then even if the arbitrator rules in favor of Kovi, the Devils are strapped trying to get below the CAP in a matter of days. Talk about a fire sale.

The Devils recourse is to renegotiate a deal with Kovi that will be approved by the league while they wait.

If the NHLPA files a grievance, I don't know if Kovi has right to negotiate a new contract with some other team.

I don't think so. If the arbitrator rules against the NHL, then the original contract is still good.
