That's the thing though, it's still an assumption. Not sure how you can make a legal case on "I think. . ."
I don't know, maybe arbitrators are there FOR that. Maybe they aren't looking to see if something was legally violated, but instead that it's not "right". Someone with more experience than me would probably be better at this. Just feels weird that a contract that has absolutely nothing violating the CBA, that pays a player to a younger age than a guy who just retired this year, and is only two years longer than a contract given out last year is not ok.
