The empty seats are due to the fact that those seats are sold to corporations not individual people. At least that's what I've read.
Which rule? The penalty shot or the instigator? I know the instigator is discretionary as Campbell pointed out. If the player is sent out to send a message in the last five minutes, then it's a suspension. In Malkin's case, he was caught in the moment. I'm pretty sure the penalty shot rule in automatic though.
I don't doubt that. Still think they ought to let people move down though. I mean good lord, if nobody is in them by the start of the third...
