Do what you want, kid. But when you get behind the wheel of a car and smoke something that slows reaction time and changes the way you make decisions, you're endangering other people. Period. Misdemeanor ain't enough in this case. That's DUI.

The sentence above led me to believe that he was smokin' it, but I guess the fact that he wasn't arrested says other things. If he was under the influence, he should face DUI charges. Simple possession is another matter altogether.

It's definitely unclear the way it's written, I guess I just assumed that since he wasn't tagged w/ a DUI that he wasn't under the influence. It gives off a strong smell before, during, and after, so there's really no way to tell. He could have smelled the actual unburnt weed and/or the pipe even if it hadn't been used for days.
If he was high, though, I'm 100% in agreement. That's a DUI.
